On October 21, 2013, in order to reduce the environmental risks of enterprises and promote the transformation of environmental management, the former Guizhou Environmental Protection Department and the Guizhou Office of the China Insurance Regulatory Commission (now Guizhou Ecology and Environment Bureau and Guizhou Banking and Insurance Regulatory Bureau) jointly issued the “Guiding Opinions on the Pilot Work of Compulsory Liability Insurance for Environmental Pollution”. On December 18, 2017, these two departments again issued the “Work Plan of Guizhou Province on the Pilot Program of Compulsory Liability Insurance for Environmental Pollution” at the same time. In order to promote the implementation of the pilot work of compulsory environmental liability insurance in Guizhou Province and guide insurance institutions to effectively identify corporate environmental risks, the Guizhou Ecology and Environment Bureau issued the “Guidelines for Risk Assessment of Environmental Liability Insurance in Guizhou Province (Trial)” (Notice from Guizhou Ecology and Environment Bureau [2019] No. 5).

 

It can be seen that Guizhou Province has made a lot of efforts to further implement environmental liability insurance. According to the “Latest Development of Guizhou Reform” issued by The Office of the Commission for Deepening Overall Reform of Guizhou Provincial Committee of the Communist Party of China on June 17th, 2021, as of the end of May 2021, 177 enterprises have completed information registration, 146 enterprises have rated for environmental risk, and 75 enterprises have been insured, with a total premium of 1.3688 million yuan and an insurance guarantee of 57.8 million yuan. Among them, 106 enterprises in the hazardous waste industry have completed information registration and environmental risk rating, and 49 enterprises in the hazardous waste industry have been insured, with a total premium of 496,800 yuan and an insurance guarantee of 22.6 million yuan.

Moreover, in order to achieve full coverage of the pilot of compulsory environmental liability insurance, Guizhou Province has explored and established a new model of environmental liability insurance with “insurance service steward + five integrations” in terms of the scope of insurance liability, the method of setting liability limits, and the operation mode of the insurance market.

Insurance service steward refers to Huatai Insurance Brokerage Co., Ltd. as the broker of environmental liability insurance in Guizhou Province, and at the same time it is determined that 8 insurance companies including Ping An Property & Casualty Insurance and Pacific Property & Casualty Insurance will establish a “co-insurance body” to assist enterprises in completing insurance, risk investigations, claims, etc.

 

Five integrations, including the integration of insurance clauses, the integration of informationalized insurance platform, the integration of the method of risk assessment, the integration of liability limit and rate, the integration of the investigation and training of hidden risks. Among them, the integration of the investigation and training of hidden risks focuses on the enterprise after the insurance, the “co-insurance body” entrusts a third-party organization to conduct a comprehensive investigation of the enterprise’s hidden environmental risks, issue a report on the hidden environmental risks and put forward suggestions for rectification, and during the insurance period the “co-insurance body” will organize insured enterprises to carry out the training of managing environmental risks, and promote the building of enterprises’ capabilities of managing environmental risks.
